ARTICLE 2. SUBJECT AND BASIS
This contract covers the sale and delivery of the products that the Buyer ordered electronically on www.nowiht.com, whose features and price are set out in Article 3. The rights and obligations of the parties are governed by Consumer Protection Law No. 6502 and the Distance Contracts Regulation. The Pre-Contract Information Form for this order is an integral part of this contract.

Payment is taken by credit or debit card in a single charge. Products are handed to the carrier within 1-3 business days of the order being confirmed; estimated delivery after dispatch is 1-2 business days. Delivery and billing details are in Article 1. Prices are in Turkish lira and include VAT.
ARTICLE 4. CONCLUSION OF THE CONTRACT
The Buyer accepts having been informed, before confirming the order, of the main features of the products, the total price including all taxes, the payment and delivery details and the right of withdrawal, and having confirmed this information electronically.
The contract is concluded when the Buyer confirms the order and the payment is completed. The Seller confirms receipt of the order by e-mail without delay and sends the Buyer a copy of this contract and of the Pre-Contract Information Form on a durable medium.
The Seller asks for any payment beyond the main price only with the Buyer's separate express consent; no option requiring an extra payment is pre-selected.
ARTICLE 5. DELIVERY AND PERFORMANCE
The Seller delivers the products to the delivery address given by the Buyer, in any case within 30 days of the order reaching the Seller. Delivery is made only to addresses in Türkiye.
If the Seller does not deliver within this period, the Buyer may terminate the contract. The Seller then refunds everything collected, including delivery charges, within 14 days of receiving the notice of termination, with statutory interest under Law No. 3095.
If performance of the order becomes impossible, the Seller informs the Buyer in writing or on a durable medium within 3 days of learning of it and refunds everything collected, including delivery charges, within 14 days of that notice at the latest. A product being out of stock does not count as impossibility.
If a product's price is shown clearly and obviously wrong because of a system error, the Seller's rights under the provisions of the Turkish Code of Obligations on mistake are reserved. If the Seller relies on them, the Buyer is informed without delay and everything collected is refunded within 14 days at the latest.
The Buyer is advised to report a parcel that looks damaged on delivery to the courier with a written record; this advice does not limit the Buyer's statutory rights.
ARTICLE 6. LOSS AND DAMAGE
The Seller is responsible for loss and damage until the product is delivered to the Buyer or to a third person, other than the carrier, named by the Buyer. If the Buyer asks for shipment by a carrier other than the one chosen by the Seller, the Seller is not responsible for loss or damage after the product is handed to that carrier.
ARTICLE 7. RIGHT OF WITHDRAWAL
The Buyer may withdraw from the contract within 14 days after the Buyer, or a person named by the Buyer, receives the product, without giving a reason and without paying a penalty. For products of one order delivered separately, the period starts on the day the last product is received. The Buyer may also withdraw before delivery. Handing the product to the carrier does not count as delivery to the Buyer.
It is enough for the Buyer to send the notice of withdrawal to the Seller in writing or on a durable medium before the period ends. The Buyer may use the return request form at www.nowiht.com/my-order/return, the e-mail address hello@nowiht.com, the KEP address theqtekstiltasarim@hs05.kep.tr or the address Bahçeşehir 1. Kısım Mah. Fırat Cad., 6. Bölge Vaditepe Sitesi D02 Blok No: 53H İç Kapı No: 5, 34488 Başakşehir/İstanbul, and may use the attached Model Withdrawal Form or make any clear statement. The Seller confirms receipt of withdrawals sent through the website by e-mail straight away.
The Buyer sends the product to Bahçeşehir 1. Kısım Mah. Fırat Cad., 6. Bölge Vaditepe Sitesi D02 Blok No: 53H İç Kapı No: 5, 34488 Başakşehir/İstanbul within 14 days of the notice of withdrawal. The Seller does not name a carrier for returns; the Buyer may use any carrier. The Seller pays the postage for returns from Türkiye: the Buyer may send the parcel carriage forward, or report the postage paid with a receipt and receive it with the refund.
If the Buyer withdraws from the whole order, the Seller refunds everything collected, including the delivery charge, within 14 days of the product reaching the Seller; if the Buyer withdraws before delivery, within 14 days of the notice reaching the Seller. The refund is made to the payment method the Buyer used, at no cost or obligation to the Buyer and in one payment. Any part paid by gift card or store credit is restored to that card or credit. On a partial withdrawal the price of the returned products is refunded and no extra shipping charge is asked for the products kept.
The Buyer is not liable for changes or wear caused by using the product in line with its function, technical features and instructions during the withdrawal period.
ARTICLE 8. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In the cases listed in Article 15 of the Distance Contracts Regulation the right of withdrawal does not apply unless the parties agree otherwise. For this order: If any product in your order falls under these exceptions, it is named here at checkout.
NOWIHT gift cards: an unused card may be withdrawn from within 14 days of purchase; there is no right of withdrawal for cards that have been partly or fully used.
ARTICLE 9. NOWIHT RETURNS
On top of the statutory 14-day right of withdrawal, the Seller accepts returns up to 30 days after delivery. For this, the product must be unworn, unwashed and with its labels attached; shipping and refund follow Article 7. This does not limit the Buyer's statutory rights.
ARTICLE 10. DEFECTIVE PRODUCTS
If a product is defective, the Buyer may use one of the remedies in Article 11 of Law No. 6502: withdrawing from the contract, a price reduction in proportion to the defect, free repair, or replacement with a defect-free item. The Seller pays the shipping for defective products. Liability for defects is subject to a limitation period of 2 years from delivery unless the law provides a longer period; it does not apply where the defect was concealed through gross negligence or fraud.
ARTICLE 11. PERSONAL DATA
The Seller processes the Buyer's personal data to conclude and perform this contract and for payment, delivery, invoicing and statutory record keeping, in line with Law No. 6698 and the privacy notice at https://nowiht.com/privacy-policy. Consent to marketing messages is not a condition of this contract.
ARTICLE 12. COMPLAINTS AND DISPUTES
The Buyer may send complaints to hello@nowiht.com, by phone to 0540 848 48 34 or by post to Bahçeşehir 1. Kısım Mah. Fırat Cad., 6. Bölge Vaditepe Sitesi D02 Blok No: 53H İç Kapı No: 5, 34488 Başakşehir/İstanbul; the Seller replies within 2 business days at the latest.
In a dispute the Buyer may apply to the consumer arbitration committee (tüketici hakem heyeti) within the monetary limits announced every year by the Ministry of Trade; above those limits, to the consumer court (tüketici mahkemesi), after first applying to a mediator as required by Article 73/A of Law No. 6502. The application may be made where the Buyer lives or where the purchase was made.
ARTICLE 13. RECORDS AND EVIDENCE
The Seller keeps the information and documents relating to this contract for the period required by law and for at least 3 years. In a dispute the Seller's electronic records and the e-mails sent to the Buyer may be used as evidence; the Buyer's right to prove otherwise by any means is reserved.
ARTICLE 14. NOTICES
Notices between the parties are sent to the e-mail address the Buyer gave with the order and to the Seller's e-mail or KEP address in Article 1. Notices of withdrawal may also use the channels in Article 7.
ARTICLE 15. ENTRY INTO FORCE
This contract was concluded electronically and entered into force when the Buyer confirmed the order. The Turkish text of the contract is binding; texts in other languages are for information.
